Terms of Service

These terms are between you and HypeUp, a marketing agency based in India. Our registered business name and address: [YOUR REGISTERED BUSINESS NAME AND ADDRESS]. In these terms, “we” and “HypeUp” mean that business. Questions about these terms can be sent to hello@hypeup.in.

HypeUp offers brand identity, graphic design, social media marketing, development, video editing, SEO and AI content services. We also offer a free Instagram strategy tool on our website.

The scope, price, payment schedule and timeline for any paid service are set out in a written proposal, quote, invoice or work order agreed between you and HypeUp. Those documents form part of your agreement with us.

The strategy tool is free to use. It asks for your name, WhatsApp number, Instagram username, page details and screenshots, and it generates a report with the help of AI. The report is a set of suggestions based on what you provide. It is not a guarantee of results, and using the tool does not oblige you to buy any service from us.

We may limit how often the tool can be used, change or pause it, or remove it at any time.

When you give us information or upload content, you confirm that:

• The information is accurate to the best of your knowledge.
• You own the content you upload, or you have permission to share it with us.
• Your screenshots do not contain other people's private data that you have no right to share.

You allow us to use this information to generate your report and to provide the services you ask for. Our use of personal data is also explained in our Privacy Policy.

You agree not to:

• Use the site or tool for anything unlawful, or to infringe someone else's rights.
• Submit false information, or request reports for an account you are not authorised to represent.
• Automate submissions, scrape the site, or try to bypass limits, security or access controls.
• Interfere with the site, its servers or other users' use of it.
• Copy or misuse HypeUp's branding, content or tools.

Instagram, WhatsApp, Meta and other platforms we mention are owned by third parties. HypeUp is not affiliated with them, and their own terms apply to your use of their services. We do not control their features, rules or algorithms, which can change at any time.

The HypeUp name, logo, website design, text and tools belong to HypeUp or its licensors. You may not copy or reuse them without written permission. You may use your own strategy report for your own business. Work we create for you under a paid engagement is governed by that engagement's written terms.

Paid work is invoiced according to the agreed proposal or work order. If an invoice is not paid on time, we may pause work until payment is received. Refunds and cancellations are covered in our Refund & Cancellation Policy.

We work hard to deliver useful strategy and creative work, but we cannot guarantee follower growth, reach, engagement, sales or any other specific result. Results depend on many factors, including platform changes that are outside our control.

To the extent the law allows, HypeUp is not liable for indirect, incidental or consequential losses, including lost profits, lost followers or lost data. For paid services, our total liability for any claim is limited to the amount you paid HypeUp for the service that gave rise to the claim. The free strategy tool is provided without charge and without warranty.

We may suspend or close your access to the site or tool if we believe you have broken these terms or are misusing our services.

We may update these terms from time to time. The “Last updated” date at the top shows when they last changed. Continuing to use the site or tool after a change means you accept the updated terms.

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts in [YOUR CITY], India.
