This policy explains what personal data HypeUp collects when you use our website and our free Instagram strategy tool, why we collect it, and what rights you have over it. It follows India's Digital Personal Data Protection Act, 2023 (the DPDP Act).
1. Who we are
HypeUp is a marketing agency based in India. For the personal data described on this page, HypeUp is the Data Fiduciary under the DPDP Act. Our registered business name and address: [YOUR REGISTERED BUSINESS NAME AND ADDRESS].
For any question about this policy, or to exercise your rights, email us at hello@hypeup.in.
2. The data we collect
When you use the free Instagram strategy tool, you may give us:
- Your name.
- Your WhatsApp number.
- Your email address (optional).
- Your Instagram username.
- Details about your page, such as the follower count, niche, and the sentence you fill in about your account.
- Screenshots you upload, such as a profile or insights screen.
- Your chosen report language (English, Hinglish or Hindi).
We also collect the details you share with us directly, such as messages sent to our WhatsApp or email.
When you visit the website, our hosting provider may record basic technical information, such as your browser type, device type, pages visited and an IP address. We use this to keep the site secure and to limit misuse of the strategy tool.
We do not ask for your Instagram password. We do not access your Instagram account, and we do not scrape Instagram. The only time we connect to your Instagram account is if you choose to connect it through Instagram's official login, which you can decide to use or not.
3. How we use your data
We use your personal data to:
- Generate your free strategy report from the information and screenshots you provide.
- Send you the report and follow up about it on WhatsApp or email, if you asked us to.
- Unlock the 30-day plan on the report page when you complete the unlock form.
- Reply to your messages and, where you agree, tell you about our services.
- Keep the tool secure, prevent spam and limit how many reports one person can request.
- Meet our legal obligations.
We do not sell your personal data.
4. Reports are generated with AI
The strategy report is produced with the help of AI models, using the information and screenshots you provide. To create it, that information is sent to third-party AI service providers who process it on our behalf. We choose providers that process data under contract and only for this purpose.
AI-generated reports can contain mistakes or outdated observations. Please read our Disclaimer before you act on any report.
5. Your consent
We process your personal data with your consent, which you give when you submit the strategy tool or the unlock form, and for the other purposes the DPDP Act allows. You can withdraw your consent at any time by emailing us. Withdrawing consent does not affect processing that happened before you withdrew it, but it may mean we can no longer provide the tool or report to you.
6. Who we share data with
We share personal data only where needed:
- With service providers who run the site and the tool for us, such as hosting, database, AI and messaging providers. They may process data only to provide services to us.
- With members of the HypeUp team who need it to do their work for you.
- Where the law requires it, or to protect the safety and rights of HypeUp or others.
7. How long we keep data
We keep personal data only for as long as needed for the purposes in this policy, or as the law requires. We delete or anonymise it when that purpose ends. Our standard retention period is [SPECIFY RETENTION PERIOD].
8. Your rights under the DPDP Act
As a Data Principal, you have the right to:
- Ask for a summary of the personal data we process about you.
- Ask us to correct or update inaccurate or incomplete data.
- Ask us to erase your personal data, once it is no longer needed for the purposes above.
- Withdraw your consent at any time.
- Nominate another person to exercise your rights if you become unable to do so.
- Get a response to a grievance. If you are not satisfied, you can approach the Data Protection Board of India as the DPDP Act provides.
To use any of these rights, email hello@hypeup.in with the subject line “Data request”. Include the WhatsApp number or Instagram username you used with the tool so we can find your records. We may ask you to verify your identity before we act on a request. We will respond within the time the law requires.
9. Deleting your data
To delete your data, email us at hello@hypeup.in with the subject line “Deletion request”. We will delete your data from our systems and confirm once it is done. We may keep limited records where the law requires us to.
10. Security
We use reasonable technical and organisational measures to protect personal data. No online system is completely secure, so please do not upload anything you would not want shared with a service provider. Before you upload a screenshot, crop out passwords, bank details, ID numbers and private messages.
11. Children
Our services are meant for adults aged 18 and above. We do not knowingly collect personal data from children. If you believe a child has given us personal data, email us and we will delete it.
12. Cookies
Our use of cookies and similar technologies is explained in our Cookie Policy.
